Terms Of Service (TOS)

Definition

The following terms shall be defined as follows:
"We," and "Mysolusy" refer to Asultancy Sdn. Bhd., the parent business of the Mysolusy brand.
“You”, “User”: any individual or business that uses Mysolusy services and/or has an account that provides access to our Services.

“Application”, “Application”: mobile/Web application or Web-Based Software developed with Mysolusy and publicly available through third-party platforms.

"Author" refers to anyone who creates or publishes anything on the Internet, more precisely on the Application.

“End User” refers to a person who uses one or more Applications developed with the Service.

“Website”: Internet Website that allows End Users to publish materials and make comments.

“User Credentials”: ​​the username and password used by the User to identify himself and use the Service, either jointly or separately.

“Order” refers to an online subscription to our Services.

“User Material” refers to any content that you upload or contribute, such as designs, photos, animations, videos, audio files, typefaces, logos, drawings, compositions, artwork, interfaces, text, literary works and any- what other ingredients

“Privacy Policy” refers to our Privacy Statement.

1. ACCOUNT TERMS AND CONDITIONS

To use the Service, you must be at least 18 years old.

You must be human. Accounts created through the use of "bots" or other automated means are prohibited.

To complete the registration procedure, you must submit your valid full name, phone number, valid email address, and any other required information.

You may not use the Services in any illegal or unauthorized manner. You may not violate any laws in your jurisdiction by using the Services (including but not limited to copyright laws).

If you find an offensive link on our Service for any reason, you can contact and alert us at any time. We will review the removal request, but are not obligated to do so or respond directly to you.

2. ACCOUNT SUSPENSION AND TERMINATION

Asultancy Sdn. Bhd. invite you to bring violations of our Standards and Terms to our attention. We reserve the right, in our sole and final discretion, to deactivate, freeze, suspend, or terminate any account for any violation of these Terms, whether actual or alleged. You must immediately notify us of any change in your eligibility to use our platform, as well as any suspicion of a breach of security or unauthorized use of your account.

Users who engage in behavior that may constitute an actual or even alleged violation – of these Terms, including but not limited to the use of automated mechanisms to send fraudulent communications, may have their accounts suspended or terminated immediately, without notice or liability, at their discretion our sole and final.

You can cancel your account at any time by accessing the "delete account" button accessible under the "Edit Profile" section via the drop-down menu next to your username. We reserve the right to terminate or suspend your Mysolusy account if you violate any of our policies or for any other reason that we will notify you of.

3. PAYMENT TERMS

We use an authorized third-party payment processor to bill the Order through your associated payment account, and you hereby authorize us to charge the applicable fees through the specified payment processing account. Sensitive financial information is stored only by our payment processor.

These third-party payment processors are also responsible for processing, managing, handling, and delivering payments on your behalf, Please refer to the terms of service of our third-party payment processing providers, which may include Bold.Pay (our payment partner), for additional details.

As a result, Mysolusy will not be responsible for any errors, fees, or currency conversion fees incurred by our payment processors, and you should periodically review their terms and policies, which will govern the provision of services to you.

3.1 CHARGES AND DISPUTES

Users can provide us with correct and up-to-date billing information in the future. Unless otherwise stated below, all payment charges are final and non-refundable. If we detect a chargeback or if we or our payment processor do not accept payment for any reason, you agree to pay us promptly any and all amounts owed to us upon notice. Our failure or inability to process any payment pursuant to this Agreement does not relieve you of your payment obligations.

Typically, chargebacks occur when a customer disputes a charge on their bank or payment processing statement. Chargebacks may result in reversal of the transaction, with associated fees refunded to you. Chargebacks may be assessed for the following reasons: I customer dispute; (ii) unauthorized or unauthorized transactions; (iii) transactions that violate the rules of the payment processor network or are allegedly illegal or suspicious; or (iv) any reversal by our payment processor or institution handling the transaction for any reason.

When a chargeback is issued, you become immediately liable to Mysolusy for the entire amount of the chargeback, as well as any related costs, fines, expenses, or penalties (including those assessed by our payment processor or the financial institution handling the transaction). You hereby expressly appoint Mysolusy as your agent, with full authority to recover this amount by debiting your account or offsetting any amount owed to you by us.

If we are unable to recover funds related to a chargeback for which you are responsible, you agree to pay us the full amount of such chargeback immediately; You therefore agree to pay all costs and expenses, including without limitation, charges assessed by our payment processor, legal fees, and other legal expenses, incurred by or on our behalf in connection with the collection of any chargebacks not yet paid.

4. REFUND POLICY

Our products are sold 'as is'. You are responsible for your purchase, and no refunds will be issued. To ensure you are satisfied with your purchase, please read all content and materials published on our website such as video tutorials, demos, requests for consultation and speak with our sales team before making your purchase decision.

5. HOSTED SERVICES

Mysolusy creates an account for the Customer and provides the customer's login details for the account. Mysolusy hereby grants to the customer a license to use the Hosted Services during the Term.

The Customer will use reasonable security measures relating to Account access details, to ensure that no unauthorized person can gain access to the Hosted Services. Mysolusy will use all reasonable efforts to maintain the availability of the Hosted Services to the Customer, but does not guarantee 100% availability.

For the avoidance of doubt, downtime caused directly or indirectly by any of the following shall not be deemed a breach of this Agreement: Force Majeure Event; fault or failure of the internet or any public telecommunications network; fault or failure of the Customer's computer system or network; any breach by Customer of this Agreement; or scheduled maintenance carried out in accordance with this Agreement. Mysolusy may suspend the provision of the Hosted Services if any amounts payable by Customer to Mysolusy under this Agreement are in arrears.

6. SCOPE OF SUPPORT

Mysolusy will make backup copies of Customer Data at least daily, ensuring that each such copy is sufficient to enable Mysolusy to restore the Hosted Services to the state they were in at the time the backup was taken. If data needs to be restored, Customer acknowledges that this process will overwrite Customer Data on the Platform.

Mysolusy must keep Customer's Confidential Information confidential; not disclose the Customer's Confidential Information to any person without the prior written consent of the Customer, and then only under confidential conditions; uses the same level of care to protect the confidentiality of Customer's Confidential Information as Mysolusy uses to protect its own similar confidential information, at least a reasonable level of care.

7. SOFTWARE REPLACEMENT

Customer will hold Mysolusy harmless, defend and indemnify against any and all third party claims or liabilities addressed within the scope of the Agreement.

Customer agrees to indemnify, defend, and hold harmless and each of their respective officers, directors, partners, employees, agents, successors, and assigns, or any of them from all claims, suits, actions laws, assessments, deficiencies, and charges imposed against the Indemnitee, and for any costs, fees, liabilities, damages, losses, expenses, and related attorneys' fees arising out of or incidental to Mysolusy.
